By accessing or purchasing from COL MARTEN, you agree to the following terms in full. If you do not agree, do not use this site.
Agreement
These Terms & Conditions govern all use of colmarten.bigcartel.com and any transactions made through it. COL MARTEN reserves the right to amend these terms at any time without prior notice. Continued use of the site following any update constitutes acceptance of the revised terms.
Orders & Payment
All orders are subject to availability and acceptance by COL MARTEN. We reserve the right to refuse, cancel, or limit any order at any time, for any reason, without obligation to provide explanation. Prices are listed in U.S. dollars and are subject to change without notice. Payment is collected in full at the time of purchase. Order confirmation does not guarantee fulfillment in the event of inventory error or unforeseen circumstances.
Processing & Shipping
Orders are processed within 3–5 business days of purchase. Shipping timelines and costs are determined at checkout based on destination and selected method. COL MARTEN is not responsible for delays caused by carriers, weather events, or any circumstances beyond our control. Risk of loss and title transfer to you upon handoff to the carrier.

Sales Tax
COL MARTEN operates out of the State of Texas. In accordance with the Texas Tax Code, applicable sales and use tax — up to 8.25% — will be applied to all orders shipped to Texas addresses. Orders shipped outside of Texas may be subject to the applicable state and local tax rates of the destination.
Returns & Refunds
All return requests must be initiated within 14 days of order processing. Items must be unworn, unwashed, and in original condition with all tags attached.
Approved returns are issued as store credit only. No monetary refunds will be issued for change of mind, sizing, or buyer's remorse.
Any item received with a confirmed manufacturing defect or undisclosed beauty mark is eligible for a full monetary refund. To initiate a claim, contact us through the contact page with your order number and documentation of the issue. COL MARTEN reserves the right to assess and verify all defect claims before a refund is issued.
Items marked as final sale are not eligible for return or store credit under any circumstances.
Intellectual Property
All content on this site — including but not limited to films, photography, graphics, the COL MARTEN name, and wordmark — is the exclusive property of COL MARTEN and protected under applicable intellectual property laws. No content may be reproduced, copied, distributed, or used in any form without express written permission from COL MARTEN.
Disclaimer of Warranties
This site and all products and content are provided "as is" without warranties of any kind, express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. COL MARTEN does not warrant that the site will operate without interruption or error.
Limitation of Liability
To the fullest extent permitted by law, COL MARTEN and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site or any products purchased through it. In no event shall COL MARTEN's total liability exceed the amount paid for the specific order giving rise to the claim.
Nothing in these terms limits any rights you may hold under the Texas Deceptive Trade Practices Act (Tex. Bus. & Com. Code §17.41 et seq.).
Indemnification
You agree to indemnify and hold COL MARTEN and its affiliates, officers, employees, and agents harmless from any claims, damages, losses, or expenses — including reasonable attorneys' fees — arising from your use of this site, your violation of these terms, or any content you submit or transmit through the site.
Governing Law & Jurisdiction
These terms are governed exclusively by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these terms or your use of this site shall be subject to the exclusive jurisdiction of the state or federal courts located in Texas, and you consent to personal jurisdiction therein.
